CAMPFIRE/CATOOZ TRADE TERMS FOR LICENSING COMIC PACKAGES
CAMPFIRE A/S' ("C"), CVR no. 30488326, Nannasgade 28, DK-2200 Copenhagen N, phone no. +45 21869500, is licensing C-Packages featuring comics and videos under the registered trademark CATOOZ®. Licensed C-Packages are subject to the following trade terms (please also refer to HYPERLINK "http://catooz.helpserve.com" http://catooz.helpserve.com):
I. License Fees
The C-Package license fee varies across countries and depends on currencies. The C-Package license fee is paid via the customer's mobile phone, credit card, E-payment account or user account with the site offering the C-Package. The customer will be informed of the license fee when ordering a C-Package. The C-Package license fee does not include regular network- and roaming charges. The C-Package can be upgraded to CATOOZ Generic, which enables the customer to buy additional comics. To upgrade the C-Package the customer has to accept new trade terms governing this application type.
II. MISCELLANEOUS
When licensing a C-Package the customer accepts:
(I) that the customer has no cooling-off period because the C-Package is delivered immediately, cf. the Danish Consumer Contracts Act;
(II) that the license follows the SIM card and is non-transferable;
(III) that the license expires 360 days after downloading a C-Package;
(IV) that comics and videos featured in a C-Package are no longer available or readable when the license has expired;
(V) that C is not responsible for any compatibility issues relating to the C-Package if
(a) the C-Package was downloaded to an unsupported handset model,
(b) the site offering the C-Package did not display a list of compatible models, or
(c) the C-Package was downloaded, obtained or installed without authorization from C or C’s partners;
(VI) that C is entitled to remove any comics and videos included in a C-Package if this is demanded by the holder of the IP rights and that no charges will be refunded to the customer; and
(VII) that the customer, if necessary, may only contact C via C's helpdesk at HYPERLINK "http://catooz.helpserve.com" http://catooz.helpserve.com.
III. IP RIGHTS
The copyrights (© CAMPFIRE A/S 2003-2009), other IP rights and any downloads/comics/videos belong to C/C's business partners and may not be copied, adapted or in any other way be subject to actions, which are reserved by C/C's business partners.
IV. DISCLAIMER
C disclaims all liability for any error, fault or damage the download might cause, directly or indirectly.
V. PRIVACY STATEMENT
Information on the customer's phone number/C ID, the licensed C-Packages and the time of visits are stored in C's secured database. This is necessary in order to be able to license the C-Package and to send requested information to the customer. The information will not be disclosed to anyone outside C without the customer's explicit consent.
VII. GOVERNING LAW
These trade terms are governed by Danish law.
